Purchase and Construction Agreement Contract

PROJECT TITLE: Proposed One (1) Storey Two (2) Bedroom Residence

LOCATION: Lot 12 Blk 4 Walnut Subdivision, Pasig City

OWNER: Mr. and Mrs. Eugene T. Cruz


GENERAL CONDITIONS OF THE CONTRACT

This agreement is made and enters into this July 25, 2015 by and between Roger L. Ricafort, LJI Home Consultant, and Mr and Mrs. Eugene T. Cruz, LJI Home Builder will be the contractor of the proposed project.

The parties hereto, for in considerations hereinafter, hereby covenant and agreed as follows:

  1. That the owner/client will purchase a parcel of lot, 135 sqm lot area from Richard D. Gutierrez of LJI Home Builder and one storey residence to be constructed by LJI Home Builder
  2. The contractor will be responsible for the construction and supervision of One Storey Bedroom Residence.
  3. That the general conditions of the contract, specifications, plan, as well as drawings with each pages signed by client and contractor relating thereto form the integral part of the contract.
  4. Scope of Work

The contractor, in consideration of the payment to be made by the Owner of the sum money that amount of One Million Two Hundred Thousand Pesos (Php 1,200,000.00) hereinafter named, agrees to furnish all labor, materials, equipment tools and other facilities and the satisfactory and faithful performance of all works necessary to commence and complete the following phases of works.

a. Materials and Finishes

1. Roofing materials – rib type 0.4 mm
2. Trusses – steel trusses
3. Exterior and Interior Walls
4. Flooring – granite flooring (single coating)
5. Cabinets – built-in cabinet
6. Ceiling – metal furring
7. Windows – clear sliding windows
8. Installation of Electrical and Power System
9. Installation of water and waste line system
10. Painting – Boysen and Davies

5. Changes

There are alterations, additions, or omissions of work or materials specified or shown in the drawings during the progress of construction.

a. All changes on the approved plans shall be approved by LJI Home Builder’s Architect and the owner.

b. If such changes are made the corresponding value or amount must be agreed upon in writing or mutual between the Owner and the Contractor

6. Schedule of Construction

The work to be performed by the contractor under this contract shall be commenced not later than april 2016 and shall be completed no later than September 2016 unless an extension of time has been authorized or approved by the owner in writing.

7. The Contract Sum

7.1 The owner agrees that for and in consideration of the faithful performance by the contractors in accordance with the provisions of this contract, he/she shall pay the contractor sum of one million two hundred thousand pesos (Php 1,200,000)

7.2 It is expressly agreed by both parties that no changes shall be made in the above mentioned contract amount as a result of any fluctuation on the cost of materials and/or labor.

 

8. Payments

8.1 Down-payment of two hundred thousand pesos (Php 200,000) shall be made by the owner on account of the contract on this contract and will be made monthly installment for the remaining balance. In case the owner terminates this agreement, the 50% of down payment will not be refundable.
The parties to this agreement hereby agree to full performance of the covenants contained herein.

IN WITNESS WHEREOF, the parties to this Agreement have on the day and year first above given, hereunto set their hands at the bottom of this page and on the left hand margin of all other pages of this Agreement.
